When browsing Flameart.us's site, and/or using other services provided here, all customers agree to comply with the Terms of Use. Flameart.us has adopted these policies to be in compliance with governing laws and regulations, requirements of its network environment, security of other customers, and the rights of Internet users.

Privacy

It is not our policy to ask or collect any personal information. However if you for some reason provide us with any personal information it will not be sold to third parties and it will be kept on secure servers and protected using industry standard security measures.

When you visit our site, our web server may collect web site usage information from you that is not personally identifiable. This data, as well as any demographic information you may choose to provide to us, will be used to tailor our site and its product lines.

Any contact information gathered may be used for marketing our site or our affiliate sites. An opt-out option will always be available for respondents.

NO artwork of any media format is to be used for a commercial purpose without written permission. All services provided by Flameart.us may be used for lawful purposes only. Transmission, storage, or distribution of any information, data or material in violation of any applicable law or regulation is prohibited. This includes, but is not limited to: copyrighted material, trademark, intellectual property, material we judge to be threatening or obscene, material that advocates or calls for the commission of crimes or civil harms to any person, group of people, corporation, country, or any entity, or material protected by trade secret and other statute without proper authorization. Any notification of claimed copyright infringement must follow the Digital Millennium Copyright Act.

Flameart.us is required by law to notify law enforcement agencies when it becomes aware of the presence of child pornography on or being transmitted through its network.

SPAM
Spamming, the sending of unsolicited mass email from or through a Flameart.us server or using an email address that is maintained by Flameart.us, or by referencing the domain name in newsgroups is STRICTLY prohibited. Flameart.us will be the sole arbiter as to what constitutes a violation of this provision. Violators will be immediately suspended and banned forever.

Indemnification
You agree to use all Flameart.us services and facilities at your own risk. Flameart.us specifically disclaims all warranties of merchantability and fitness for a particular purpose. In no event shall Flameart.us be liable for any loss, or loss of data, or other commercial damage, including but not limited to special, incidental, consequential or other damages. By accepting this agreement, you agree to waive and hold Flameart.us harmless from any claims relating to any action taken by Flameart.us. Customer agrees that it shall defend, indemnify, save and hold Flameart.us harmless from any and all demands, liabilities, losses, costs, claims, including reasonable attorney's fees asserted against Flameart.us, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, its agents, employees, or assigns. Customer agrees to defend, indemnify and hold harmless Flameart.us against liabilities arising out of:

(1) any injury to person or property caused by any products sold or otherwise distributed in connection with Flameart.us's server;

(2) any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party;

(3) copyright infringement and

(4) any defective products sold to customer from Flameart.us's server.

Flameart.us shall be the sole judge of what violates this Policy.
